A. Purpose

This Acceptable User Policy ("AUP") outlines the rules and guidelines for using the services provided by The Pinnacle Group Inc. ("Services"). It applies to all customers who use these services under the Master Services Agreement or any related contracts. Terms not defined here will follow the definitions provided in the Master Services Agreement.



B. Scope

This AUP is incorporated into all agreements between The Pinnacle Group Inc. and its customers. It is designed to ensure the responsible and lawful use of the Services while protecting both the customer and The Pinnacle Group Inc.



C. Acceptance

By using the Services, customers agree to comply with this AUP. Failure to adhere to these guidelines may result in suspension or termination of services.



D. Lawful Use

Customers must use the Services only for lawful purposes and in compliance with all applicable laws, including privacy and data protection regulations. The following activities are strictly prohibited:
1. Illegal Content: Hosting or distributing material that violates any law, including pirated content, illegal software, or unauthorized media files.
2. Malicious Activities: Engaging in hacking, phishing, spamming, or distributing malware.
3. Fraudulent Schemes: Promoting or participating in high-yield investment programs (HYIP) or similar fraudulent activities.
4. Unauthorized Access: Using proxy servers or other methods to gain unauthorized access to networks or systems.
5. Defamatory Material: Hosting content that harms the reputation of individuals, businesses, or organizations through false or misleading claims.
6. P2P File Sharing: Using peer-to-peer networks or torrent software for illegal file sharing.



E. Prohibited Content

The Pinnacle Group Inc. prohibits the hosting of:
1. Adult Content: Pornography, child exploitation material, or sexually explicit content.
2. Violent or Harmful Content: Material that promotes violence, hate speech, or discrimination.
3. Copyright-Infringing Material: Content that violates intellectual property rights, including pirated software, music, or videos.



F. Customer Responsibilities

Customers agree to:
1. Secure Accounts: Protect their accounts and passwords from unauthorized access.
2. Prevent Misuse: Ensure that their use of the Services does not harm The Pinnacle Group Inc.'s servers or networks.
3. Backup Data: Maintain backups of their data; The Pinnacle Group Inc. is not responsible for data loss.
4. Avoid Abuse: Refrain from overusing resources, launching denial-of-service (DoS) attacks, or engaging in activities that disrupt other users.
5. Respect Staff: Treat The Pinnacle Group Inc. employees and representatives with respect. Disrespectful behavior may result in account termination.



G. Content Management

1. No Control: The Pinnacle Group Inc. does not monitor or control customer content but reserves the right to remove any material that violates this AUP.
2. No Liability: Customers use the Services at their own risk. The Pinnacle Group Inc. is not responsible for the accuracy or quality of information hosted by customers.
3. Bandwidth: Connection speeds are not guaranteed beyond The Pinnacle Group Inc.'s network.



H. Network Security

1. Prohibited Activities: Customers must not attempt to bypass security measures, probe networks, or distribute tools designed to compromise security.
2. Cooperation: The Pinnacle Group Inc. will cooperate with law enforcement and other authorities in investigating violations of network security.



I. Indemnification

Customers agree to indemnify and hold The Pinnacle Group Inc. harmless from any claims, losses, or damages arising from their use of the Services or violation of this AUP.



J. Monitoring and Enforcement

1. Complaint-Based Review: The Pinnacle Group Inc. will review content only upon receiving complaints. Violations may result in account suspension or termination.
2. Remedial Actions: The Pinnacle Group Inc. may disable access to content, block services, or take legal action against violators.



K. Reporting Violations

To report violations of this AUP, contact the Abuse Department at legal@thepinnaclegroup.in. Provide details such as IP addresses, timestamps, and evidence of the violation.



L. Amendments

The Pinnacle Group Inc. reserves the right to modify this AUP at any time. Customers will be notified of changes via email or other communication methods.
