This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or an entity) and The Pinnacle Group Inc., a company located at 201, 2nd Floor, Amrapali Plaza, Amrapali Marg, Block E, Vaishali Nagar, Jaipur, Rajasthan 302021, India ("Licensor", "we", "us", or "our"). By using or accessing the managed server and hosting solutions provided by The Pinnacle Group Inc. ("Services"), you agree to the terms and conditions set forth in this Agreement. If you do not agree with any of the terms, you are not authorized to use the Services.

1. Grant of License
The Pinnacle Group Inc. grants you a limited, non-exclusive, non-transferable license to access and use the Services in accordance with this Agreement, for your internal business purposes. This license is subject to your compliance with the terms and conditions herein.

2. License Restrictions
You may not:
Copy, modify, distribute, sell, lease, or sublicense the Services. Reverse engineer, decompile, or disassemble any part of the Services. Use the Services for unlawful or unauthorized purposes. Transfer the Services or sublicense your rights under this Agreement to any third party.

3. Third-Party Licenses and Services
The Pinnacle Group Inc. uses third-party services and licenses, such as payment gateways and other software solutions, to deliver the Services. These third-party licenses are governed by their respective terms and conditions. You agree to comply with any applicable terms and conditions of these third-party licenses. The Pinnacle Group Inc. is not responsible for any third-party service or software, including any issues related to the payment gateway or other external services.

4. Payment Gateway
The Pinnacle Group Inc. may integrate payment gateway services as part of its Solutions. You acknowledge and agree that these payment services are governed by separate terms and policies of the third-party payment processor. By using such services, you agree to abide by their terms, including any applicable fees, privacy policies, and security practices.

5. Support and Maintenance
The Pinnacle group inc don't provide individual support for applications or software,nor do we take responsibility for the performance or availability of third-party licenses and software, including but not limited to payment gateways.Support will be provided through email, phone, or other means as outlined in the service level agreement(SLA).

6. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to immediately notify The Pinnacle Group Inc. of any unauthorized access or use of your account.

8. Privacy and Data Protection
You agree to comply with applicable data protection laws and understand that The Pinnacle Group Inc. will process and store your data according to our Privacy Policy. You retain ownership of your data, but you grant us the necessary rights to process, store, and transfer your data in the course of providing the Services.

9. Indemnity
You agree to indemnify, defend, and hold harmless The Pinnacle Group Inc., its officers, employees, agents, and affiliates from any claims, damages, losses, or expenses arising out of or related to your use of the Services, including any violation of third-party licenses or the terms of this Agreement.

10. Limitation of Liability
To the maximum extent permitted by applicable law, The Pinnacle Group Inc. shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits or data, arising out of the use or inability to use the Services, even if The Pinnacle Group Inc. has been advised of the possibility of such damages.

11. Warranties and Disclaimers
The Services are provided "as is," and The Pinnacle Group Inc. makes no representations or warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the Services will be error-free, secure, or free from defects.

12. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to this Agreement shall be resolved through arbitration in Jaipur, Rajasthan, India, under the rules of the Arbitration and Conciliation Act, 1996.

13. Miscellaneous
Entire Agreement: This Agreement constitutes the entire agreement between you and The Pinnacle Group Inc. with respect to the Services and supersedes all prior agreements or understandings.
Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect. Amendments: The Pinnacle Group Inc. may amend this Agreement at any time. We will provide notice of changes, and your continued use of the Services will constitute acceptance of the updated terms.
By accessing and using The Pinnacle Group Inc.'s Services, you acknowledge that you have read, understood, and agreed to the terms and conditions set forth in this End User License Agreement.
