Copyright Infringement Policy

Introduction

Hostnetindia strictly adheres to its copyright policies and issues clear legal notices to those who violate our terms and conditions. Our copyright policy outlines the essential components required in a legal notice and references applicable policies. These terms and conditions govern the submission of notices for alleged complaints, providing a clear process to address fraudulent or invalid complaints.

Complaint Procedure

Hostnetindia accepts only written complaints that include detailed information about the complainant. The complaint must contain the following:

  • Name, phone number, complete address, and an electronic or physical signature of the authorized owner.
  • Identification of the copyrighted work(s).
  • Details of the material you wish to remove or modify, including its internet location.
  • Any additional details required by law to include in a copyright complaint.
  • A statement, under penalty of perjury, confirming that the information in the complaint is accurate and that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Your signature.

Submit your complaint using one of the following methods:

Note: You may be liable for losses, including costs and other damages, if you misrepresent the original matter. If you are uncertain whether material available online infringes your copyright, we recommend consulting an attorney before filing a complaint.

Hostnetindia may respond to notices by disabling access to the alleged infringing material or terminating services. If our team removes access in response to such a notice, we will make a good-faith effort to communicate with the affected customer.

VPS Counter-Notice Procedure for Customers

Hostnetindia does not maintain backups on a server or hosting plan basis for VPS hosting. While VPS hosting is protected against sudden hardware failures, other risks such as hacker attacks, viruses, accidental commands, or user errors may cause data loss, and these are the responsibility of the user.

Upon receipt of a notice from Hostnetindia indicating that a claim of infringement has been made and that material has been removed or disabled, you may provide a counter-notice as per applicable law. The counter-notice must include the following information:

  • A physical or electronic signature.
  • Proof of the material that has been removed or disabled, including the location where it appeared before removal or disabling.
  • A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled due to a mistake or misidentification.
  • Your name, address, phone number, and a statement consenting to the jurisdiction of the Federal District Court for the judicial district in which you are located, or, if outside India, the jurisdiction of the India District Court for the District of Jaipur. You must also confirm that you will accept service of process from the complainant or their agent.

Upon receiving a proper counter-notice pursuant to applicable law, Hostnetindia will take appropriate steps to restore the material within 10-14 business days, unless the copyright owner initiates court proceedings to prevent restoration and informs Hostnetindia of these actions.
